I would like to introduce RAYHAWK AUTOMATION, N W, INC and a new
marketing concept we call: CLUBware Software (Trademark).
RAYHAWK AUTOMATION, N W, INC is an Oregon software development
firm. We specialize in local support of the IBM PC and compatible
machines. We acquired our first PC in November of 1981, and have
since developed a lot of useful software for the PC. We think that
the CLUBware concept is an effective way to market it.
Since the PC Clubs provide services that are important to their
communities, we would like to do something that assists the clubs.
CLUBware Software is an attempt at this.
Ok, so what is CLUBware? CLUBware is an enhancement to the
FREEWARE concept (Trademark - HEADLANDS Press) originally used to
distribute PC-TALK. We have sold your club a liscense to distribute
our software as club disks. We ask you to make a donation if you find
the software useful.
An important change from the FREEWARE approach is that the right
to copy the CLUBware diskette is constrained in several ways. The
constraints are mainly for the benefit of the Clubs, but also allow
the software to be used within the PC community economically.
The Club is requested to distribute copies of CLUBware software
for a nominal fee ($5.00 is suggested) which would cover the cost of
the diskette and the time to do the formatting and copying. We want
the club to make some money, but not at the expense of losing its
non-profit status. This is the fundamental intent of CLUBware
software: to allow the club to make money so that it can afford to
provide better services to its members.
Obtaining a copy of a CLUBware diskette does not include unlimited
rights to make additional copies. Unlimited copying can only be done
by RAYHAWK AUTOMATION, N W, INC and licensed clubs. The purchaser is
granted permission to make backup copies needed for personal use.
Purchasers of a copy of a CLUBware diskette are asked to make a
donation to the authors if the software is found to be useful. As
with the FREEWARE concept, this donation is meant to encourage the
developers to provide other useful software in CLUBware form. We
suggest a donation of $5.00. You are welcome to send more.
Corporations that obtain a copy of a CLUBware diskette from a Club
may acquire rights to unlimited copying WITHIN the corporation by
making a $100.00 payment to RAYHAWK AUTOMATION, N W, INC. This is not
a requested donation: it is a payment for unlimited internal copying
rights. The $100.00 price is an intelligent compromise that allows us
a reasonable income while assisting businesses.

Software development firms that acquire a CLUBware diskette from a
Club may acquire rights to include parts of CLUBware in software they
sell. The payment for this is also $100.00, and includes full
internal copying rights: no company need pay more than $100.00. If
the software firm wishes to provide its customers with a full copy of
CLUBware, it should obtain another copy from the Club. Any further
use by the customer is as if he obtained it directly from the Club.
The constraints controlling distribution by corporations and
software development firms are an attempt overcome some serious
weaknesses in both the FREEWARE concept and regularly distributed
software.
